The service offered consists of providing an AI-powered image generation tool accessible online.

Any order implies unreserved acceptance of these Terms.

Article 2 - Service Description

2.1 Nature of the Service

Coloriboo offers an artificial intelligence image generation service accessible through an online platform. The service allows users to:

  • Download generated images in various formats

2.2 Service Availability

The service is accessible 24/7, subject to technical maintenance operations. The Seller strives to maintain optimal availability but cannot guarantee uninterrupted accessibility.

2.3 Technical Characteristics

The Customer is informed that the quality and relevance of generated images depend on:

  • The quality and precision of the instructions provided
  • The technical capabilities of the artificial intelligence
  • Inherent limitations of image generation technology

The Seller does not guarantee that generated images will exactly match the Customer's expectations.

Article 3 - Pricing

3.1 Service Prices

Prices for our services are indicated in euros, including all taxes (VAT included), as applicable on the date of order.

The prices in effect are those displayed on the site at the time of order validation.

3.2 Price Modifications

The Seller reserves the right to modify its prices at any time. Modifications do not apply to orders already validated and paid.

3.3 Plans and Credits

Depending on the chosen offer, the Customer can:

Article 4 - Payment Terms

  • Not attempt to circumvent the technical limitations of the service

  • Of a pornographic, pedophilic, or violent nature
  • Infringing on others' privacy
  • Violating third-party intellectual property rights
  • For illegal or fraudulent purposes
  • Representing identifiable real persons without their consent

Failure to comply with these conditions results in immediate account suspension without refund.

Article 6 - Right of Withdrawal

6.1 Principle

In accordance with consumer protection laws, the Customer has a period of 14 days from the conclusion of the contract to exercise their right of withdrawal without having to justify reasons or pay penalties.

6.2 Exception to Right of Withdrawal

In accordance with applicable consumer protection regulations, the right of withdrawal cannot be exercised for:

  • The supply of digital content not provided on a tangible medium whose performance has begun with the Customer's prior express consent and for which they have waived their right of withdrawal

By validating their order, the Customer expressly requests immediate performance of the service and waives their right of withdrawal upon first use of credits.

6.3 Withdrawal Procedures

Refunds will be made within 14 days following withdrawal notification, using the same payment method as used for purchase.

Article 7 - Intellectual Property

7.2 Ownership of Generated Images

Images generated by the Customer through our service belong to the Customer, subject to:

  • Compliance with these Terms
  • Compliance with applicable legislation
  • Limitations related to third-party rights

The Customer has a complete, non-exclusive, worldwide license to use the images they generate, for commercial or personal use.

7.3 Customer Liability

The Customer is solely responsible for their use of generated images. Coloriboo cannot be held liable for any violation of third-party rights resulting from the Customer's use of images.

Article 8 - Warranties

8.1 Conformity Warranty

The Seller warrants that the service conforms to the descriptions presented on the site.

8.2 Warranty Limitations

The Seller does not warrant:

  • That generated images will exactly match Customer expectations
  • Total absence of bugs or technical errors
  • Continuous and uninterrupted service availability
  • Absolute uniqueness of generated images

Article 9 - Liability and Force Majeure

9.1 Limitation of Liability

The Seller's liability can only be engaged in case of proven fault and is limited to the amount of the relevant order.

The Seller cannot be held responsible for:

  • Indirect damages resulting from use or inability to use the service
  • Loss of data, time, profits, or business opportunities
  • Service interruptions due to force majeure
  • Inappropriate or illegal use of images by the Customer

9.2 Force Majeure

The Seller shall not be held liable for any delay or failure to perform its obligations resulting from force majeure as defined by applicable law.

Article 10 - Personal Data

The processing of the Customer's personal data is carried out in accordance with our Privacy Policy available on the site and the General Data Protection Regulation (GDPR).
